Formal Opinion

Formal opinions clarify the meaning of existing law and interpret issues that are ambiguous, obscure, or otherwise unclear as these apply to the particular circumstances presented in a formal opinion request. Requests for opinion are governed under the Board’s rule, 43 Texas Administrative Code (TAC), Section 215.4, which contains specific requirements that an opinion request must meet to be eligible for Board consideration.

Board’s rule, 43 Texas Administrative Code (TAC), Section 215.4

Currently, the TxDMV Board has been presented with a formal request seeking clarification of the new point and relocation protest rights of new engine, transmission, and rear axle licensed franchise dealers. Preliminarily this request has been deemed eligible for Board consideration. Before this matter is presented to the board, the agency offers the general public an opportunity to review the request (attached below) and provide comments. The period for posting comments runs from May 10, 2013 through June 10, 2013.

This page will update throughout the formal opinion process and posted comments will be accessible below.

If you have any questions, please contact the TxDMV Motor Vehicle Division at 512-465-7327.
