Escrow Accounts

You may deposit funds in an escrow account set-up with TxDMV to pay for your oversize/overweight permits. To set up an escrow account:

  • Contact the Motor Carrier Division to obtain an account number
  • Complete the Letter of Agreement
  • Deposit an initial sum of $305, payable by cash, cashier's check, money order, personal/company check, MasterCard, Visa, Discover or American Express
  • If you would like to remit your payment via a wire transfer, please refer to our wiring Instructions
  • Complete the Deposit for Escrow Account payment slip
  • Submit the Letter of Agreement, Deposit for Escrow Account and payment to:

Permit Surety Bonds

If you are not required to obtain TxDMV Motor Carrier Registration (MCR) or Unified Carrier Registration (UCR), you may be required to file a surety bond with the TxDMV in an amount set by the Texas Department of Transportation (TxDOT) and payable to TxDOT for any damage that might be sustained to the highway because of the operation of the equipment for which a permit is issued.

How to File

Permit surety bonds are available through insurance and bonding companies.

You must file your bond with TxDMV. We encourage you to fax the completed bond and mail the original immediately by regular mail.

An electronic or fax copy of the bond is valid for 10 days only after which the original bond must be on file with TxDMV to obtain a permit.

The bond must meet the following requirements:

  • The company name and address is printed on the face of the bond.
  • Issued and signed by a resident Texas agent or issued by a non-resident agent with a valid Texas insurance license on behalf of an authorized insurance company.
  • Signed by an authorized person from the company requesting the bond.
  • Issued on Form 439 for $10,000.
  • Filed with TxDMV before a permit is issued.
  • Must have a seal or power of attorney.

A certificate of continuation is not acceptable. The bond must be renewed every year prior to August 31.

Venue of a suit for recovery on the bond is in Travis County.

By administrative rule making, the department has adopted the following rules concerning surety bond requirements:

  • within the effective period of an Annual Bond (September 1 through August 31), all owned or leased vehicles to that company may be eligible for oversize/overweight permits;
  • bonds must be permit surety bonds executed on the standard form or facsimiles thereof (facsimiles will only be valid for ten days, original must be received after that time for continued permit issuance);
  • bonds must be in the amount of $10,000;
  • the name of the Principal must be the same throughout the form;
  • the Principal's home town address and zip code must be shown;
  • all signatures are required on both original and facsimile and
  • the seal of the surety must be affixed.

Fourteen-day termination evidence must be given so the appropriate permit personnel can be notified in case the bond is cancelled prior to its expiration date.

Emergency Relief Permit

emergency-reliefTxDMV issues the Emergency Relief Permit for the transportation of divisible commodities consisting of emergency relief supplies. The Emergency Relief Permit is only available during national emergencies or major disasters declared by the President of the United States. This permit expires 120 days from the date of the President’s declaration.

Vehicles moving under this permit may travel to and within the geographical area covered by the emergency declaration to either:

  • Assist in expediting debris removal from roadways, staging areas, or temporary structure locations, or
  • Deliver relief supplies (the entire load must consist of relief supplies).

Note: This permit is only valid for travel in Texas. If the geographical location listed in the emergency declaration is in another state, carriers must contact each state they will travel through for individual state permits.

There is no fee for this permit.

More Information

  • You may not travel over a load-restricted bridge or load-restricted road when exceeding the posted capacity of the bridge or road.
  • Review your permit for specific curfews and conditions that apply to your load and movement.
  • A copy of the president's emergency declaration must be carried with the permit.
  • Permit may not be used in conjunction with any other oversize or overweight permits.

 

Route Inspections for Oversize/Overweight Permits

In addition to the requirements of the permit type you are applying for, if your vehicle or load exceeds one of the following dimensions, you must apply for and certify a Route Inspection prior to your permit being issued.

  • Width – 20'
  • Height – 18'11"
  • Length – 125'

A representative of your company must physically inspect the proposed route to ensure the safety of the load, traveling public and the state infrastructure. A company representative must certify (sign and date) the route inspection proposal after the route has been physically inspected.

After receiving your application, TxDMV will select a tentative route. Please submit your route inspection requests three to five days in advance of the proposed movement date to allow sufficient time for the route inspection process to be completed properly.

MCD will contact you if your application is incomplete.

  • General escort and equipment requirements apply to both permitted vehicles and escort vehicles.
  • Hauling more than one item may not cause nor increase a dimension or weight to exceed Texas legal size and weight limits. For example, 10' wide steel plates may be stacked provided the overall height does not exceed 14' and the weight does not exceed legal axle or gross weight limits.
  • Law enforcement assistance may be required by TxDOT to control traffic when a permitted vehicle is being moved within the corporate limits of a city, or at such times when law enforcement assistance would provide for the safe movement of the permitted vehicle and for the traveling public's safety.

Annual Length Permit

annual-length-permitTxDMV issues an annual length permit for the transport of loads exceeding Texas legal length limits. This permit is an annual permit that expires one year from the effective date.

To qualify for this permit, vehicles and loads must be:

  • No greater than 8’6” wide, 14’ high, 110’ long for vehicles and loads on a trailer, or
  • No longer than 75’ long for single vehicles moving empty or hauling a load.

Note: This permit adds an annual option to the existing 30-, 60-, and 90-day length permit.

The annual permit fee is $960. Fees are payable by:

  • MasterCard, VISA, Discover or American Express (a service charge of 25 cents per permit plus 2.25 percent will be added.)
  • Funds deposited in a pre-established escrow account
  • Permit Account Card (PAC) or FirstPay Account established through Frost Bank San Antonio
  • Personal check, business check, cashier's check or money order, payable to the Texas Department of Motor Vehicles
  • Cash (MUST be delivered to a TxDMV Regional Service Center)

A permit fee will not be refunded after the permit number has been issued unless such refund is necessary to correct an error made by the Motor Carrier Division.

You are responsible for routing and obtaining current restrictions and information concerning hazardous weather-related road conditions prior to movement. Active time permit holders may use TxPROS to generate free routes for loads moving under their time permit.
