Subject: Procedural Updates for NMVTIS/Out-of-State Value Limiting Brands

NMVTIS to Texas Conversion Chart

These documents contain text of correspondence sent by TxDMV to the county tax assessor-collectors, statutory agents who provide vehicle registration and titling services for citizens in Texas. This information is provided to apprise the general public of issues affecting the state’s vehicle titling and registration process.

PURPOSE

To provide you with a policy and procedure update for handling value limiting brands.

DETAILS

Since the full implementation of NMVTIS, the department has discovered two situations that require changes to how certain value limiting brands are processed.

The first change involves the reconstructed brand from specific states. When accepting a Certificate of Title that contains a “RECONSTRUCTED” remark from Alaska, Louisiana, Massachusetts, Oregon, or Pennsylvania, the Texas record should be marked as “REBUILT SALVAGE.” Do not apply the “RECONSTRUCTED” remark to the Texas record when it involves these states. Rebuilt Salvage vehicles from these states are branded as reconstructed on the Certificates of Title; however, these vehicles meet the NMVTIS and Texas definition of a Rebuilt Salvage vehicle. In these situations, failure to apply the “REBUILT SALVAGE” remark to the Texas record will result in a NMVTIS error (Error #910) appearing on your NMVTIS Inquiry Error Report for the missing brand.

The second change involves the NMVTIS “Totaled” brand (Brand #31). Originally the department interpreted the definition of the NMVTIS “Totaled” brand to mean the vehicle was nonrepairable; however, since implementation, we have been informed that this brand equates to a salvage vehicle. When receiving a NMVTIS Inquiry Error (Error #910) for a missing Brand #31, please handle this vehicle in accordance with the Owner Retained procedures before applying the Rebuilt Salvage brand. The applicant must complete the VTR–61 and must pay the $65 Rebuilt Salvage Fee before your office can apply the “REBUILT SALVAGE” brand to the Texas record.

COUNTY ACTION

Please apply the “REBUILT SALVAGE” brand to the Texas record when accepting a Certificate of Title with a “RECONSTRUCTED” brand from Alaska, Louisiana, Massachusetts, Oregon, or Pennsylvania.

Please process NMVTIS Brand #31 (Totaled) as a salvage vehicle. In addition, you must contact the customer to obtain a completed VTR–61 and collect the $65 Rebuilt Salvage Fee before applying the “REBUILT SALVAGE” brand to the Texas record.

Please review the attached “NMVTIS to Texas Conversion Chart” (Rev. 07/14), and distribute this updated document to all affected staff. The information in the attached chart will also be updated and available in the next revision of the NMVTIS Guide.
