Subject: Senate Bill 266, Possessory Lien Notification.
To notify you of a change made by SB 266 enacted by the 82nd Legislature, Regular Session.
Effective September 1, 2011, a person filing a mechanic's lien must notify the county tax office and pay the $25 administrative fee regardless of the date the vehicle was left for repairs and the charges incurred.
In addition, no later than the 15th business-day after receiving notice, the county tax assessor-collector's office must provide a copy of the notice to the owner of the motor vehicle and each lienholder recorded on the title. County tax offices are no longer required to use certified mail for the notification process.
Notify the owner and lienholder within the 15 business day time period and review the mechanic lien documents thoroughly when filed with your office.
Franchise dealers remain excluded from the notification requirements to your office and the requirement to obtain a signed work order.
