Subject: Title Revocation Project for State Farm Insurance
These documents contain text of correspondence sent by TxDOT to the county tax assessor-collectors, statutory agents who provide vehicle registration and titling services for citizens in Texas. This information is provided to apprise the general public of issues affecting the state's vehicle titling and registration process.
To provide you information regarding the release of liens on titles being returned to the department for "Rebuilt Salvage – Damaged" branding.
As discussed in RTB #020-06, the Vehicle Titles and Registration Division (VTR) anticipated revoking approximately 3,000 Texas titles due to notification by State Farm Insurance that the titles were issued without the required "Rebuilt Salvage – Damaged" brand. The actual number of titles is approximately 9,000. VTR placed a legal restraint on these records and notified currently registered owners and/or lienholders to return the titles to the department for branding. These records show "Title Revoked" and "Legal Restraint – Contact TxDOT (#Salvage)," in addition to the "Rebuilt Salvage – Loss Unknown" brand. The corrected title will be issued with a "Rebuilt Salvage – Damaged" brand.
VTR may correct title errors at no charge only if the applicant did not create the error. However, VTR is unable to issue a corrected title if the customer requests a change to the existing vehicle record, such as removing a lienholder. To modify the record, the owner must apply for a corrected title and pay the title fee.
When VTR receives a request to change the vehicle record in addition to correcting the brand, we will return the submitted documentation to the owner. The owner will be instructed to take the ownership document, applicable supporting document(s) such as release of lien, and payment to their county tax assessor-collector's office. The corrected title will be issued with the proper brand and without the lien.
Current owners of vehicles with records flagged as described above will not be required to submit the following forms and/or fees:
- Rebuilt Affidavit, VTR-61
- $65.00 Rebuilt Salvage Fee
- Application for Nonrepairable Vehicle Title or Salvage Vehicle Title, VTR-441, including $8.00 fee
Only title and registration fees, if applicable, should be collected. Registration may be renewed on these records.
