Intermodal Shipping Container Port Permit

container shipTxDMV issues an annual permit for the transport of intermodal shipping containers, transported in Texas within 30 miles of select port authorities or ports of entry that are located in a county contiguous to the Gulf of Mexico or a bay or inlet opening into the gulf. The permit is an annual permit that expires one year from the effective date.

The truck-tractor and semitrailer combination must have six axles or seven axles with the following axle distances:

Six Axles:

  • Approx. 647 inches between the front axle of the truck-tractor and the last axle of the semitrailer,
  • 51 to 52 inches between the axles in the truck-tractor two-axle group, and
  • 60 inches between the axles in the semi-trailer three-axle group

Seven Axles:

  • Approx. 612 inches between the front axle of the truck-tractor and the last axle of the semitrailer,
  • 51 to 52 inches between the axles in the truck-tractor three-axle group, and
  • 60 inches between the axles in the semi-trailer three-axle group

The gross weight and axle weights allowed are based on the number of total axles. Maximum gross and axle weight limits are:

Six Axles:

  • Gross weight – 93,000 pounds
  • Truck-tractor single axle – 13,000 pounds
  • Truck-tractor two-axle group – 18,500 pounds per axle
  • Semitrailer three-axle group – 16,400 pounds per axle

Seven Axles:

  • Gross weight – 100,000 pounds
  • Truck-tractor single axle – 15,000 pounds
  • Truck-tractor three-axle group – 14,900 pounds per axle
  • Semitrailer three-axle group – 15,400 pounds per axle

An intermodal shipping container is an enclosed, standardized, reusable container used to pack, ship, move, or transport cargo. The container must be transferred to/from a ship, vessel, or a rail system for international transportation without unloading or reloading the cargo.

Note: A vehicle moving with this permit may operate on a state, county, or municipal road approved by the Texas Department of Transportation if the vehicle displays the permit windshield sticker, has the required axle numbers and distances and does not exceed the maximum gross weight or axle weight limits. Permit applicant must select ports, counties, and municipalities in which travel will occur at time of application.

  • You may not operate your vehicle on the interstate highway system nor on a load-posted road or bridge if the gross weight of the vehicle combination and load, or the axles and wheel loads, are greater than the established and posted limits.
  • You are responsible for routing and obtaining current restrictions and information concerning hazardous weather-related road conditions prior to movement.

Fluid Milk Transport Permit

milk permit imageTxDMV issues an annual permit for the overweight transport of fluid milk on routes approved by the Texas Department of Transportation. The vehicle combination may not exceed Texas legal size limits. The permit is an annual permit that expires one year from the effective date.

The truck-tractor and semitrailer combination must have six axles and must have the following axle distances:

  • 15 feet or more between the first (steer) axle of the truck-tractor and the first axle of the first axle group (drive axles),
  • 36 feet or more between the first drive axle and last trailer axle, and
  • 48 to 54 inches between the axles within each axle group.

The gross weight may not exceed 90,000 pounds. Axle and axle group weight limits are:

  • Truck-tractor single axle – legal weight
  • Two-axle group – 36,500 pounds total
  • Three-axle group – 42,500 pounds total

Note: A vehicle moving with this permit may operate on a federal interstate highway or a state, county, or municipal road if the vehicle displays the permit windshield sticker, has the required number of axles and axle distances, and and does not exceed the maximum gross weight or axle/axle group weight limits. Permit is valid for travel on specific routes that have been approved by the Texas Department of Transportation. Permit applicant must select routes to be traveled at time of application.

North Texas Intermodal Permits

containersTxDMV issues an annual permit for the transport of intermodal shipping containers, transported in Bowie County on US71/US59 from the Arkansas state border to the eastbound entrance ramp for IH49, which do not exceed legal size limits. This permit is an annual permit that expires one year from the "movement to begin" date.

The truck-tractor and semitrailer combination must have six axles and must have:

  • Approx. 647 inches between the front axle of the truck-tractor and the last axle of the semitrailer,
  • 51 to 52 inches between the axles in the truck-tractor two-axle group, and
  • 60 inches between the axles in the semi-trailer three-axle group

Permit Surety Bonds

If you are not required to obtain TxDMV Motor Carrier Registration (MCR) or Unified Carrier Registration (UCR), you may be required to file a surety bond with the TxDMV in an amount set by the Texas Department of Transportation (TxDOT) and payable to TxDOT for any damage that might be sustained to the highway because of the operation of the equipment for which a permit is issued.

How to File

Permit surety bonds are available through insurance and bonding companies.

You must file your bond with TxDMV. We encourage you to fax the completed bond and mail the original immediately by regular mail.

An electronic or fax copy of the bond is valid for 10 days only after which the original bond must be on file with TxDMV to obtain a permit.

The bond must meet the following requirements:

  • The company name and address is printed on the face of the bond.
  • Issued and signed by a resident Texas agent or issued by a non-resident agent with a valid Texas insurance license on behalf of an authorized insurance company.
  • Signed by an authorized person from the company requesting the bond.
  • Issued on Form 439 for $10,000.
  • Filed with TxDMV before a permit is issued.
  • Must have a seal or power of attorney.

A certificate of continuation is not acceptable. The bond must be renewed every year prior to August 31.

Venue of a suit for recovery on the bond is in Travis County.

By administrative rule making, the department has adopted the following rules concerning surety bond requirements:

  • within the effective period of an Annual Bond (September 1 through August 31), all owned or leased vehicles to that company may be eligible for oversize/overweight permits;
  • bonds must be permit surety bonds executed on the standard form or facsimiles thereof (facsimiles will only be valid for ten days, original must be received after that time for continued permit issuance);
  • bonds must be in the amount of $10,000;
  • the name of the Principal must be the same throughout the form;
  • the Principal's home town address and zip code must be shown;
  • all signatures are required on both original and facsimile and
  • the seal of the surety must be affixed.

Fourteen-day termination evidence must be given so the appropriate permit personnel can be notified in case the bond is cancelled prior to its expiration date.
